Terms of Service

These terms govern your use of SafeGuideEd (the “Service”), operated by SafeGuideEd, Inc. (“SafeGuideEd,” “we”). By signing in or using the Service, you agree to these terms. If you do not agree, do not use the Service. Districts that license SafeGuideEd under a signed Master Service Agreement are governed by that agreement; where these terms conflict, the signed agreement controls.

1. Accounts

You may use SafeGuideEd if you are an educator, administrator, or coordinator at a school or district that has authorized your access, or if you are an individual Texas educator with a valid Canvas, Schoology, Clever, or ClassLink account. You are responsible for activity under your sign-in. Keep your credentials private. Notify us at security@safeguided.com if you suspect a compromise.

2. The Service

SafeGuideEd helps educators draft TEKS-aligned lessons, tag T-TESS evidence, run the HB 1605 parent preview, prepare TIA submissions, and publish to supported LMS providers. Features evolve. We may add, change, or remove functionality with reasonable notice. Material changes that affect a district's contracted scope follow the change-control process in the signed agreement.

3. Your content

Lessons, assessments, comments, and other content you create or upload remain yours. By using the Service you grant SafeGuideEd a non-exclusive license to host, process, and display your content for the sole purpose of operating the Service for you and the district that authorizes your access. We do not use your content to train AI models. We do not sell it. We do not display it to other tenants.

4. AI-generated output

The Service produces AI-generated lesson plans, summaries, and assessments. Output is drafted from current TEKS, STAAR, and T-TESS reference materials, but generative models can make mistakes. You are the professional educator. Review every output before delivering it to students or filing it as evidence. SafeGuideEd is not liable for decisions made on the basis of an unverified AI output.

5. Credits, payment, and refunds

Individual teachers can sign up free with 100 starter credits. Additional credits are sold in packs starting at $10 / 1,000 credits. Credits never expire. Districts purchase flat-rate unlimited plans under a separate written agreement. Texas sales tax is included in displayed prices. Unused credits are refundable on account closure at the per-pack price actually paid, less any fees required by our payment processor.

6. Acceptable use

Do not: (a) attempt to access another tenant's data; (b) use the Service to harm students or staff, including content that violates Texas Education Code or federal civil rights law; (c) scrape, mirror, or republish the Service or its outputs for resale; (d) probe, attack, or reverse-engineer the Service except as permitted by law; (e) use the Service to generate material that infringes another author's rights.

7. Termination

You may close your individual account at any time from the settings panel. Districts may terminate per the signed agreement. We may suspend or terminate access for material breach of these terms or for activity that endangers the platform or other tenants. On termination we delete or return personal data per the Privacy Notice and the signed agreement.

8. Warranties and limits

The Service is provided “as is.” We disclaim implied warranties to the maximum extent allowed by law. We do not warrant uninterrupted service, and we do not guarantee that AI outputs are free of error. Where a signed district agreement provides stronger warranties, that agreement controls. To the extent permitted by law, our aggregate liability for any claim arising out of these terms is limited to the fees you (or your district) paid SafeGuideEd in the twelve months preceding the claim. Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited under Texas law.

9. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts in Travis County, Texas, unless the signed district agreement designates a different venue.

10. Changes

We may update these terms. Material changes will be posted here, and where required by contract, sent to district administrators at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
